By entering the Plaine Products Mother’s Day Giveaway (the “Sweepstakes”), you will be bound by these Terms & Conditions and you acknowledge that you satisfy all eligibility requirements. “Plaine Products” means Plaine Products, LLC.

Eligibility. Open to individual legal residents of the 50 United States or the District of Columbia and are the age of 18 prior to May 8th, 2020. Employees of Plaine Products and its affiliates in the Sweepstakes, and their immediate family members(spouses, parents, siblings, children and each of their respective spouses regardless of where they reside) or members of their households, are not eligible to participate. By entering, all participants and/or entrants agree to release Plaine Products from and against all claims and damages arising in connection with each entrant’s participation and/or entry in the Sweepstakes and/or his/her receipt or use of any element of a Prize awarded in this Sweepstakes[ including any injury or harm resulting from or any travel or activity related thereto]. Any and all warranties and guarantees with respect to any prize element are subject to the respective manufacturer’s terms. This Sweepstakes is governed by U.S. law and is subject to all applicable federal, state and local laws and regulations. Void outside the U.S. and its territories, possessions, and commonwealths and where prohibited by law

Prize(s) and Winner Selection Method. Plaine Products will award the following prizes in the following quantities as described below:

• One Grand Prize including contributions from Alter Eco, Larry’s Coffee, TreeTribe, River Organics, Plaine Products and Vivian Blanco – ARV: $334.00

Odds of winning a particular prize depend on number of entries received. Each eligible entry will be eligible to win only one prize and when an entry is selected to win a prize, it will not be eligible to win a second prize. Potential prize winners (each a “Prize Winner”) will be chosen by Sponsor in a random drawing from among all eligible entries received during the entire Sweepstakes Period on or about May 8th, 2020 (the “Prize Drawing”).

Prize(s) will be fulfilled by Plaine Products. Each prize will be awarded “as is” and without warranty of any kind, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). If you win a prize, you may not transfer, assign, or redeem the prize for cash.

Plaine Products reserves the right to substitute prizes if necessary. Approximate Retail Value (ARV) of each prize is estimated and actual/appraised value may differ at time of prize award.

Plaine Products anticipates that the potential Prize Winners will be notified within five days following the Prize Drawing. Plaine Products anticipates that the potential Prize Winners will be contacted either by phone, e-mail from the email address info@plaineproducts.com, or in writing between May 4th, 2020 and May 8th, 2019 (subject to change). The Prize Winners may be required to execute an affidavit of eligibility, a non-disclosure agreement, and release of liability and publicity (where permitted by law), and, if so requested, must return the same, fully-executed, within five days of date of issuance of prize notification. Plaine Products will have no liability for winner’s failure to receive notices due to spam, junk e-mail, or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information. If the winner cannot be contacted, is ineligible, or fails to claim the prize within three days from the time award notification was sent, the prize may be forfeited and an alternate winner selected. Receipt by a winner of the prize offered is conditioned upon compliance with any and all federal, state, and local laws and regulations.

How to Enter. Beginning at 9:00 a.m. Eastern Time (“ET”) on May 4th, 2020 until 11:59 pm ET on May 8th, 2020 (the “Sweepstakes Period”), you may enter the Sweepstakes in any of the following ways: (i) online, by visiting the Happy Mother’s Day Giveaway website [https://mailchi.mp/plaineproducts/mothersday2020] (the “Happy Mother’s Day Giveaway Website”) and completing and submitting the online entry form (limit one (1) online entry, per valid email address, per eligible person per day) or by mail, by hand printing your name, complete address, phone number (including area code) and date of birth (to confirm eligibility only) either on a postcard or on a separate piece of paper no larger than 8½ x 11 inches, and mailing the postcard or paper in an envelope with the proper postage affixed to: “Happy Mother’s Day Giveaway Entry Submission, 803 Floral Ave Terrace Park, OH 45174 USA”. Mail-in entries must be postmarked by May 5th, 2020 and received by May 8th, 2020. Limit one (1) entry per stamped envelope. Mechanically reproduced or pre-printed mailing labels or entries generated by script, macro or other automated or mechanical means and entries by any means which subvert the entry process will not be accepted.  Incorrect, illegible, corrupt, and incomplete entries are void. All eligible entries received will be entered in the Prize Drawing. When you enter through the Website, you may be asked to consent to receive promotional e-mails and reminders for upcoming promotions and to receive information about Plain Products. See Plaine Products’ privacy policy for complete terms, available at https://www.plaineproducts.com/privacy-policy/. Consent to receive such e-mails is optional, does not have to be agreed to in order to be eligible to enter the Sweepstakes, and does not improve your chances of winning. Plaine Products and its affiliates, subsidiaries, parent corporations, advertising and promotion agencies, all local sponsors, and their respective officers, directors, shareholders, employees and agents, and any and all Internet servers and access provider(s) (collectively, “Released Parties”) are not responsible for: any incorrect or inaccurate entry information; human error; technical malfunctions; failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, server providers, or software, including any injury or damage to participant’s or any other person’s computer relating to or resulting from participation in this Sweepstakes; inability to access the Website; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entries that are processed late or incorrectly or are incomplete or lost due to computer or electronic malfunction or traffic congestion on the Internet or at any website; printing, typographical, human or other errors; and any entries which are late, lost, incomplete, delayed, misdirected, stolen, mutilated, inaccurate, illegible or arrive postage due, or any combination thereof. Entries are considered only upon receipt. Proof of mailing or online submission is not considered proof of delivery or receipt. All entries become the property of Plaine Products and will not be returned. A purchase will not increase your chance of winning. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PLAINE PRODUCTS RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.  If by reason of a printing or other error, more prizes are claimed than the number set forth in these rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.  You further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived.  You acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.”  The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims.

General Prize Conditions. All costs, taxes, fees, and expenses associated with a prize or the acceptance and use of any element of a prize not specifically addressed above are the sole responsibility of the winner. The specifics of all aforementioned elements of any prizes in the Sweepstakes will be solely determined by Plaine Products. Some restrictions may apply. Prizes cannot be transferred, substituted or redeemed for cash except at Plaine Product’s sole discretion. Plaine Products reserves the right to substitute any prize, or portions thereof, with a prize of comparable or greater value, at its sole discretion.

Additional Terms.  Plaine Products and its affiliates reserve the right to modify or cancel a Sweepstakes at any time (provided that no such alteration will favor any one entrant or class of entrants over another). Plaine Products and its affiliates are not responsible for: (a) lost, misdirected, late, or incomplete entries or for inaccurate entry information; (b) any operation or transmission error, theft, unauthorized access to, or alteration of, entries; or (c) damage to any computer or device resulting from downloading Sweepstakes materials. Plaine Products may disqualify any individual found to be: (x) tampering with a Sweepstakes; (y) violating these Terms & Conditions; or (z) acting in an unsportsmanlike or disruptive manner or with intent to threaten or harass any person. Incomplete and robotic, automatic, programmed or similar entries will be disqualified. By using an email address to enter this Sweepstakes, you represent and warrant that you are the authorized owner of the email account used to enter and you understand that at the actual time of entry you (the owner of the email address) will be deemed to be the participant and must comply with these Terms & Conditions in the event of a dispute as to entries submitted by multiple users having the same e-mail account.

If any errors occur in the selection of a potential winner, Plaine Products may award the prize(s) by random drawing from among all eligible claimants.

Disputes/Governing Law. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of any entrant or Sponsor in connection with the Promotion, will be governed by and construed in accordance with the laws of the State of Ohio without giving effect to any choice of law or conflict of law rules or provisions which would cause the application or the laws of any jurisdiction other than the State of Ohio. Any action or litigation concerning this Agreement must take place exclusively in the federal or state courts sitting in Hamilton County, Ohio, and you expressly consent to the jurisdiction of and venue in such courts and waive all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, must be resolved individually, without resort to any form of class action. You agree to service of process by mail or other method acceptable under the laws of the State of Ohio. ANY CLAIMS, JUDGMENTS AND/OR AWARDS ARE TO BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. YOU HEREBY WAIVE ANY RIGHTS OR CLAIMS TO ATTORNEY’S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, IDENTIFIABLE PERSONS, OR THIRD PARTY PARTICIPANTS, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.

Miscellaneous. Each Sweepstakes is governed by the laws of the United States. By entering a Sweepstakes, you agree (for yourself and your heirs) that Plaine Products and its respective affiliates, agents, subsidiaries, parent companies, advertising/marketing and promotion agencies, all local sponsors, and their respective officers, directors, shareholders, employees and agents, and any entity involved in any aspect of the Sweepstakes (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Sweepstakes, even if caused or contributed to by the negligence of any of the Released Parties.

You agree that Plaine Product’s decisions related to each Sweepstakes and all distribution of prizes are final. Each winner agrees that, by participating in a Sweepstakes, Plaine Products and their respective affiliates may use the winner’s name and email address in any manner and in any medium for its promotional purposes without additional compensation, including posting in a winner’s list, except where prohibited by law, and Plaine Products and their respective affiliates may be required to disclose the winner’s address to state regulatory authorities.
